1. Acceptance of Terms
Welcome to Koru. By accessing or using the Koru platform, including our website, mobile applications, and related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.
These Terms constitute a legally binding agreement between you and Koru (“we,” “us,” or “our”). By creating an account, importing data, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.
2. Description of Service
Koru is a multi-sport fitness tracking and analytics platform designed to help athletes monitor, analyze, and improve their performance across a wide range of activities. The Service includes, but is not limited to:
- Activity tracking and import — Record and import workouts for running, cycling, swimming, hiking, walking, and other fitness activities from devices and third-party platforms.
- Health data aggregation — Track heart rate, sleep patterns, daily steps, calories, and other health metrics synced from wearables and connected apps.
- Performance analytics — View detailed breakdowns of pace, distance, elevation, splits, training load, trends, and progress over time.
- Training plans — Create, follow, and manage structured training plans for races and personal goals.
- Data export — Export your fitness and health data in standard formats at any time.
- Gear and race management — Track equipment usage, mileage, and race history.
- Social features — Share activities, follow friends, and participate in clubs (where available).
We may add, modify, or discontinue features of the Service at our discretion. We will make reasonable efforts to notify you of significant changes.
3. Account Registration
To access certain features of the Service, you may be required to create an account. When registering, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information to keep it accurate and complete.
- Keep your login credentials secure and confidential. You are responsible for all activity that occurs under your account.
- Notify us immediately if you suspect unauthorized access to or use of your account.
You must be at least 16 years of age to create an account and use the Service. By registering, you represent that you meet this age requirement.
4. Data Ownership
Your data belongs to you. This is a foundational principle of Koru.
All fitness data, health data, activity records, training plans, and any other personal content you create, import, or store through the Service (“Your Data”) remains your property at all times. Koru acts as a custodian of Your Data, not an owner.
Specifically:
- You retain full ownership of all activity data (runs, rides, swims, hikes, and any other workouts), health metrics (heart rate, sleep, steps, calories), training plans, race records, gear logs, and any notes or content you add.
- You can export Your Data at any time in standard, portable formats. We will never lock you in or make it difficult to take your data elsewhere.
- You can delete Your Data at any time. When you request deletion, we will remove Your Data from our active systems. Refer to our Privacy Policy for details on data retention during backup cycles.
- We do not sell Your Data. We will never sell, rent, or trade your personal fitness or health information to third parties.
- Limited license to operate — By using the Service, you grant Koru a limited, non-exclusive license to process, store, and display Your Data solely for the purpose of providing and improving the Service for you. This license terminates when you delete Your Data or your account.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable local, state, national, or international laws or regulations.
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or any systems or networks connected to the Service.
- Scrape, crawl, or use automated means to access or extract data from the Service without our prior written consent.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service or any part thereof.
- Interfere with or disrupt the integrity or performance of the Service, including by transmitting viruses, malware, or other harmful code.
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
- Use the Service to harass, abuse, or harm other users.
- Upload or transmit fabricated fitness data with the intent to deceive other users or manipulate leaderboards, challenges, or social features.
We reserve the right to suspend or terminate your account if we reasonably believe you have violated these provisions.
6. Intellectual Property
The Service and its original content (excluding Your Data), features, functionality, design, branding, and code are and will remain the exclusive property of Koru and its licensors. This includes, but is not limited to:
- The Koru name, logo, and visual identity.
- The software, algorithms, and user interface designs.
- All text, graphics, and media created by Koru.
- Our analytics methodologies and data processing systems.
The Service is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
For clarity: your fitness data, health data, and personal content are yours, not ours. This section applies only to Koru's own intellectual property.
7. Third-Party Integrations
The Service may integrate with third-party platforms and services, including but not limited to:
- Garmin Connect
- Strava
- Apple Health
- Google Fit
- Wahoo
- Polar Flow
- Suunto
- COROS
Your use of these third-party integrations is governed by their respective terms of service and privacy policies. Koru is not responsible for the practices, content, or availability of third-party services. When you connect a third-party account, you authorize Koru to access and import your data from that platform in accordance with the permissions you grant.
Third-party integrations may be modified, suspended, or discontinued at any time due to changes in third-party APIs or policies beyond our control.
8. Disclaimers
The Service is not a medical device and does not provide medical advice.
All fitness data, health metrics, training suggestions, analytics, and performance insights provided through the Service are for informational and educational purposes only. They are not intended to diagnose, treat, cure, or prevent any medical condition or to replace professional medical advice.
- Heart rate, sleep, and health data displayed in Koru are sourced from consumer wearable devices and may not be medically accurate. Do not rely on this data for medical decisions.
- Training plans and suggestions are general in nature. Always consult a qualified healthcare professional or certified coach before starting or modifying any exercise program, especially if you have pre-existing health conditions.
- Pace, distance, and elevation data depend on GPS accuracy and device sensors, which may vary. Koru is not responsible for inaccuracies in recorded data.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KORU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO KORU, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
This limitation applies regardless of the legal theory on which the claim is based, including negligence, breach of contract, or strict liability, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.
10. Termination
Either party may terminate this agreement at any time:
- You may delete your account at any time through the Settings page. Before deletion, you will have the opportunity to export Your Data.
- We may suspend or terminate your account if you violate these Terms, engage in fraudulent or harmful activity, or if we are required to do so by law. We will provide reasonable notice when possible.
Upon termination:
- Your right to access the Service will cease immediately.
- We will make Your Data available for export for a reasonable period (at least 30 days) following a termination initiated by us, unless the termination is due to illegal activity.
- After the export window, Your Data will be deleted from our active systems in accordance with our Privacy Policy.
Sections of these Terms that by their nature should survive termination will survive, including but not limited to Data Ownership, Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law.
11. Modifications to Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes:
- We will notify you by email and/or through a prominent notice within the Service at least 30 days before the changes take effect.
- The updated Terms will be posted on this page with a revised “Last updated” date.
- Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
- If you do not agree to the updated Terms, you may delete your account and export Your Data before the changes take effect.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or other representative proceeding.
